REFUNDS & WITHDRAWAL
If you change your mind, write to us. Email kontakt@nush.pl within 14 days of your purchase and we will refund it, whether or not you are strictly entitled to it in law. We would rather give the money back than keep money someone regrets spending.
1. YOUR STATUTORY RIGHT OF WITHDRAWAL
If you are a consumer resident in the European Union or the European Economic Area, you generally have the right to withdraw from a distance contract within 14 days, without giving any reason and without penalty. This right comes from Directive 2011/83/EU, and in Poland from the ustawa o prawach konsumenta.
How the immediate-upgrade acknowledgement affects it
What you buy here is digital content that is supplied immediately — your purchase moves the global counter as soon as the payment clears. Before paying, you are asked to tick a box that does two things: it asks us to begin performance immediately, and it acknowledges that you will therefore lose your right of withdrawal once the upgrade has been applied.
This follows Article 16(m) of Directive 2011/83/EU (art. 38 pkt 13 ustawy o prawach konsumenta). If you did not give that express consent and acknowledgement, your 14-day right of withdrawal remains fully intact and you may exercise it as described below.
We record the acknowledgement with the payment so that both sides can evidence what was agreed.
2. OUR VOLUNTARY REFUND PROMISE
Separately from, and in addition to, your statutory rights, we operate a voluntary refund policy: if you ask within 14 days of the purchase, we will refund it in full. You do not have to give a reason and you do not have to explain yourself.
This is a contractual promise we are making to you, not a description of the legal minimum. It does not limit or replace any statutory right you have — where the law gives you more, the law wins.
3. HOW TO ASK
Email kontakt@nush.pl with:
- the Stripe receipt reference or checkout reference for the payment;
- the amount and approximate date;
- the nickname you used, if any.
Never send card numbers, CVV codes or full bank details by email. We do not need them and we will not ask for them. The Stripe receipt reference is enough to find your payment.
Any clear, unambiguous statement that you are withdrawing is sufficient — you do not have to use a particular form. If you prefer a form, the model wording is in section 8.
4. HOW AND WHEN YOU GET THE MONEY BACK
- Refunds are made through Stripe to the same payment method you used. We cannot refund to a different card or account.
- We process refunds within 14 days of accepting your request, and for statutory withdrawals within 14 days of being informed of your decision.
- Your bank or card issuer may then take several further working days to show the money. That part is outside our control.
- You will not be charged any fee by us for a refund. If your bank applies currency-conversion differences between the payment and the refund, we do not control and cannot compensate for that difference.
5. WHAT A REFUND DOES TO THE GAME
The public total and the leaderboard are based on net successful payments. When a payment is refunded:
- the amount is removed from the global total;
- the corresponding leaderboard entry is removed;
- if the net total falls below a milestone threshold, Benny's visual stage can be re-locked for everyone.
A partial refund reduces the amount counted rather than removing the entry altogether. This is a deliberate design choice: the counter is meant to reflect money actually received and kept.
6. CHARGEBACKS AND DISPUTES
If you raise a dispute or chargeback with your bank, the payment is excluded from the public total while the dispute is open, and permanently if it is resolved against us. Please contact us first — a direct refund is faster for you than a chargeback and avoids a dispute record on the payment.
7. WHEN WE MAY REFUSE, OR REFUND ON OUR OWN INITIATIVE
We may decline a refund request that is made in bad faith — for example, a pattern of repeated purchases and refunds intended to manipulate the leaderboard, or a request relating to a payment we reasonably believe to be fraudulent. Declining a voluntary refund never overrides a statutory right you actually hold.
We may also refund a payment without being asked, and cancel the corresponding entry, where we believe the payment was fraudulent, unauthorised, made by a minor, or made using a payment method the payer was not entitled to use.

9. COMPLAINTS
If you are unhappy with how we handle a refund, our complaints procedure is set out in section 8 of the Terms of Use. We respond to complaints within 14 days, and consumers may also use the out-of-court routes described there.
